Remember the case of a 10-year-old rape victim from Chandigarh, Punjab, impregnated by her uncle, had shocked the entire nation earlier this year, which also made international headlines. Her parents petitioned for her to be allowed to have an abortion of the girl, the Supreme Court rejected the plea as her pregnancy was discovered when she was 30 weeks pregnant, and aborting the child would have put her life in danger. Both the culprits (uncles) of the girl were sentenced to life imprisonment by a fast-track trial in a special court when they were found guilty.
The girl had no knowledge of her pregnancy or the abortion request that her parents made in court. As per the report, her parents insisted that doctors must not reveal to the girl that she was pregnant. On 17 August, she gave a birth to a baby girl, but her father has requested the hospital to keep the pregnancy a secret from her mother. As per the officials, the girl has been told by her parents and doctors that she was being operated upon “for a stone in her stomach”. The doctors had described the condition of the newborn and her mother as “stable”.
Her parents asked the doctors to hand over the baby for adoption. A couple (name not revealed) from Maharashtra has now adopted the baby and promised her a new, loving and caring life. The couple found the baby on the Central Adoption Resource Authority’s website. The paperwork to complete the adoption process is still underway, meanwhile, Sangeeta Vardhan, the chairman of the Child Welfare Committee, said that the pre-adoption undertaking has been signed and the required formalities have been completed.
As per the law, abortions are illegal after 20 weeks of pregnancy in India. However, many women and families have been petitioning in the high court for permission to abort the child because of rape or fetal abnormalities. In the past several years, the courts have heard a number of requests for late-term abortions from families of young rape victims. Rape is a gruesome crime of violence committed against women or a girl, but an abortion does not erase the violence or heal the pain. It just put an end to the life of a second victim of the crime, an unborn child.
In this case, this is certainly a fresh turn in the life of the newborn baby. We just hope and pray that it brings a positive change in the life of its mother as well.
